REGISTRATION:

Proper and complete online registration is required to bid. 

All bidders must provide valid contact information including full name, address, phone number, and email address to register.  If you are being represented by a real estate agent, you must provide their full name, license # and contact information prior to bidding for any property.

Bidders are also required to provide proof of funds, bank letter of credit or other financial documentation before bidding. Registration and proof of funds must be received NO LATER than 12:00 PM the day of the auction.

By registering, all bidders acknowledge having read and agree to be bound by the Auction Terms and Conditions. 

All bidding in this auction is being conducted online. (If you need assistance registering or  placing a bid please call our office for assistance at 407-873-2747

To place a bid, bidders have the option to bid in one of three ways 

1) Bid the current asking price if no other bids present

2) Bid a specific amount 

3) Call our office prior to bidding for assistance (407-873-2747) if you are NOT being represented by a real estate agent.

This auction is programmed to prevent "Last Second Bidding". Our system automatically extends the bidding time by 10 minutes in order to allow other bidders to respond.

BUYER'S PREMIUM:

The buyer’s side of the commission is called “Buyer’s Premium”. 

(The Highest Bid + Buyer’s Premium = Sales Price)  

Upon acceptance from the seller, a buyer's premium is added to the highest bid. And it will be included in the total purchase price to be paid by the successful bidder(s).

Buyer's premium may vary from property to property. Please read the exact details from the property you are bidding on.

If You Are The Winning Bidder: 

Please have your agent submit a signed purchase agreement to the seller within the time specified in “sale terms and conditions ” for the property you are bidding on.

Notice to Winning Bidder: 

Important – If you are the winning bidder at the end of the auction and back out without submitting a contract, you will have been considered breaching our terms of use of our bidding submission system and liable for a $500 withdrawal penalty fee.  We will invoice you for that amount.

SALES PURCHASE CONTRACT SIGNING:

At the conclusion of the auction the Winning Bidder will be notified and receive an email and/or phone call confirming their winning bid status. 

You must then submit a valid Residential Contract of Sale (MAR) together with all the proper corresponding disclosures submitted by the seller. 

REMEMBER: Once you become the highest bidder and your bid is accepted by the seller, the required documentation is exactly the same as a regular traditional standard sale.

Should the winning bidder be represented by one of our agents. You will receive a link to sign all documents electronically along with wiring instructions for submitting the required earnest money deposit to the named title company. 

IMPORTANT: 

You must be ready to sign the contract if your bid is accepted by the seller by  close of business on auction day

A Winning Bidder whose documents and deposit are not received within the required time frame is subject to paying a $500 withdrawal penalty fee.

Please note that property-specific documents are available prior to the auction end date and reviews of such documents should be undertaken PRIOR to bidding. 

All final bids are subject to Seller’s reserve or confirmation. 

Do not send contract unless you are confirmed that the seller has accepted your highest bid.

EARNEST MONEY DEPOSIT:

The Winning Bidder shall be required to make the earnest money deposit directly to the tittle company where closing will take place.  

The earnest money deposit must be deposited within 3 business days from the time the auction ended.

Winning Bidder(s) whose documents and deposit are not received within the required timeframe are subject to paying subject to paying a $500 withdrawal penalty fee.

The auction company and seller(s) reserves the right to seek additional liquidated damages using legal venues when a fraudulent misrepresentation is found the bidding party.

CLOSING:

The Winning Bidder shall close within 45 days of the auction end date, unless agreed & stated differently in the Sales Purchase Agreement.
